An enduring power of attorney is a document you sign now, to allow person act for you in the event that you lose your mental capacity in the future. It is an important advance planning tool which allows persons have their say on important matters, such as where they might live, or who controls their bank accounts, if they had dementia or unexpectedly went into a coma.
A new regime for enduring powers of attorney was introduced in April 2024. The system has been beset by difficulties and creating an enduring power of attorney has proved to be an unnecessary frustrating process. In some cases people feel that creating an enduring power of attorney under the new system is overly complicated and have not completed this important document.
